Who we are & what we do

Eyemoved is a digital property platform. We:

Provide search and discovery tools for residential and other property listings.
Enable you to contact estate agents, developers, and other property professionals (collectively, "Agents").
Offer tools such as alerts, saved properties, calculators, and insights to help you understand the market.

We do not act as your estate agent, conveyancer, lender, or financial or legal adviser. Any agreements or transactions you enter into with Agents or other third parties are separate from Eyemoved and subject to their own terms.

Eligibility & your account

To use most of the Services you must:

Be at least 18 years old.
Have the legal capacity to enter into these Terms in the UK.
Use the Services for your own personal use (unless we agree otherwise in writing).

When you create an account, you must provide accurate and up-to-date information and keep your login details secure. You are responsible for all activity that takes place under your account. If you believe your account has been compromised, you must tell us as soon as reasonably possible.

Using the Services

You agree that you will not:

Use the Services for any unlawful purpose or in breach of applicable law.
Misrepresent your identity or your connection to any property or business.
Interfere with, damage, or disrupt any part of the Services or any equipment or network used to provide them.
Attempt to gain unauthorised access to the Services, data, or systems, or circumvent security or access controls.
Scrape, harvest, or systematically extract data from the Services, including for commercial use, without our prior written consent.
Use the Services to send spam, unsolicited marketing, or other unwanted communications.

We may suspend or terminate your access to the Services if we reasonably believe you have breached these Terms or are misusing the platform.

Fair use

Listings, content & accuracy

Property listings and some other content on Eyemoved are provided by Agents or other third parties. While we ask them to ensure that their information is accurate and kept up to date, we do not guarantee:

The availability, price, or status of any property.
The accuracy or completeness of descriptions, measurements (including floor areas), or images.
The suitability of any property for your needs.

You must carry out your own enquiries, inspections, and due diligence (including obtaining appropriate professional advice) before relying on any listing or completing any transaction.

Your content & conduct

If you submit reviews, messages, enquiries, feedback, or other content via the Services ("User Content"), you:

Confirm that you have the right to submit that User Content and to grant the rights set out below.
Grant Eyemoved a non-exclusive, worldwide, royalty-free licence to use, store, copy, adapt, and display your User Content in connection with operating and improving the Services.
Acknowledge that we may moderate, remove, or refuse to publish User Content that we reasonably consider to be unlawful, misleading, offensive, or otherwise inappropriate.

You must not submit User Content that:

Is defamatory, discriminatory, threatening, or otherwise unlawful.
Infringes the intellectual property or privacy rights of any person.
Contains personal data about another person without their consent.
Contains unsolicited marketing, spam, or harmful code such as viruses, malware, or scripts.

Intellectual property

Eyemoved owns or licences all intellectual property rights in the Services and the underlying software, design, and content (excluding User Content and third party content). All such rights are reserved.

You may use the Services and view content for your personal, non-commercial use only. You must not:

Copy, reproduce, or distribute substantial parts of the Services or any content.
Use Eyemoved branding, logos, or trademarks without our written permission.
Build a competing product or service using, or referencing, any part of Eyemoved without our agreement.

No professional or financial advice

Information on Eyemoved is provided for general information only. It is not intended to amount to:

Financial, investment, tax, or legal advice.
Advice on the suitability, value, or risk of any property or transaction.

You should obtain independent professional advice before making any decision based on information obtained through the Services.

Due diligence

Our responsibility for loss or damage

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

Subject to that, we will not be liable for:

Any loss or damage that is not reasonably foreseeable when you start using the Services.
Loss of profits, business, goodwill, or anticipated savings.
Loss or corruption of data.
Any issues arising from your dealings with Agents or other third parties, including property transactions, services, or advice they provide.

To the extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with the Services or these Terms is limited to £100.

Suspension & termination

We may suspend or terminate your access to some or all of the Services if:

We reasonably believe you have breached these Terms.
We need to do so to comply with law or the order of a court or regulator.
We are making significant changes to, or withdrawing, the Services.

Where reasonably possible, we will give you notice before we suspend or terminate your access. You may stop using the Services at any time. These Terms will continue to apply to your past use of the Services.

Privacy & cookies

Our use of your personal data is described in our Privacy Policy. We use cookies and similar technologies as described in our Cookies Policy. By using the Services, you acknowledge that we will process your personal data and use cookies in accordance with those documents.

Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law, in how we run Eyemoved, or in the Services we offer. When we make material changes, we will update the "Effective date" above and may provide additional notice (for example, in-product or by email).

If you continue to use the Services after the updated Terms take effect, you will be deemed to have accepted them.

Governing law & disputes

These Terms, and any dispute or claim arising out of or in connection with them or your use of the Services, are governed by the laws of England and Wales.

You and Eyemoved agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in another part of the United Kingdom you may also bring proceedings in your local courts.
